EARTH BEAT FESTIVAL 2025
- DEFINITIONS 1.1 “Earth Beat”, “we”, “us”, or “our” refers to Earth Beat Community Limited, a not-for-profit organisation registered in New Zealand. 1.2 “Festival” means the Earth Beat Festival scheduled for 19-23 March 2025 at Ātiu Creek Regional Park, Auckland. 1.3 “Ticket” means a valid ticket for the Festival. 1.4 “Ticket Holder”, “you”, or “your” refers to the individual in possession of a valid Ticket.
- ACCEPTANCE OF TERMS 2.1 By purchasing a Ticket, you agree to be bound by these Terms and Conditions.
- ABOUT EARTH BEAT 3.1 Earth Beat is a not-for-profit, community-driven event largely organised through volunteer efforts.
- TICKETS AND REFUNDS 4.1 Tickets are non-refundable except as expressly stated in these Terms and Conditions or as required by New Zealand law. 4.2 In the event of Festival cancellation due to circumstances covered by our insurance, full refunds will be provided. 4.3 In the event of cancellation due to circumstances not covered by insurance (including but not limited to pandemics), Earth Beat will offer either: a) A partial refund of typically 80% of the Ticket price; or b) The option to retain the Ticket for a future Earth Beat Festival. 4.4 If the Festival is postponed, the confirmed alternative dates are 2-6 April 2025. Tickets will remain valid for these dates and no refunds will be offered unless required by law. 4.5 If refunds are offered, Ticket Holders must register for the refund within the specified timeframe. Earth Beat bears no responsibility if this deadline is missed. 4.6 Refund liability is limited to the face value of the Ticket only. 4.7 No refunds will be offered if the Festival commences but is subsequently cancelled or curtailed.
- ADMISSION AND CONDUCT 5.1 Earth Beat reserves the right to refuse admission or eject any person from the Festival grounds, with reasonable cause and without refund. 5.2 Valid ID must be provided for concession Tickets. 5.3 Admission may be refused for lost, damaged, or unauthorised Tickets. 5.4 By attending the Festival, you agree to abide by Earth Beat’s Alcohol Guidelines and Principles.
- PROGRAMME CHANGES 6.1 Earth Beat reserves the right to alter the Festival programme, including but not limited to changing, withdrawing or replacing artists.
- RECORDING AND PHOTOGRAPHY 7.1 By attending the Festival, you consent to being filmed, photographed, and recorded, and for such material to be used by Earth Beat for promotional purposes.
- PERSONAL INFORMATION 8.1 Your personal information will be held by Earth Beat and our ticketing partners in accordance with the Privacy Act 2020. It will not be sold or shared with third parties. 8.2 If you opt to receive updates, you may unsubscribe at any time.
- LIMITATION OF LIABILITY 9.1 To the fullest extent permitted by law, Earth Beat’s liability for any claim arising from the Festival is limited to the face value of the Ticket.
- AMENDMENTS 10.1 Earth Beat reserves the right to amend these Terms and Conditions. Any changes will be effective upon posting on the Earth Beat website.
- GOVERNING LAW 11.1 These Terms and Conditions are governed by New Zealand law and any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
By purchasing a Ticket, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
